BERC Tribunal To Execute Cases Of Power & Energy Sector

Cases related to country’s Power and Energy sector are not to be executed from now on at the regular courts. A Tribunal was formed recently under Bangladesh Energy Regulatory Commission (BERC) which will deal with the lawsuits related to country’s Power and Energy sector.

The tribunal will enact as the judicial board of the BERC under the BERC act 2003. The government already has started transferring the related lawsuits from High Court to the BERC tribunal.

The tribunal consists of seven members including a chairman. Dr. Selim Mahmud was appointed as the first chairman of the BERC tribunal. Another two members were also appointed and the appointments of other members are in progress. The tribunal has already started hearing on a few cases.

Dr. Selim Mahmud said, “We have started our operation. The tribunal will handle all the cases related to the country’s Power and Energy sector. You don’t have to go to the regular courts to file such cases and in fact, from now on you can’t file any lawsuits there.” There are thousands of cases already filed regarding this sector and more are to come, he added.

According to the act of BERC, the verdict of the tribunal will be considered final; no one will have any chance to appeal against the verdict at other courts. The verdict will have to be approved by the BERC. However, according to constitutional right, anyone will be able to file writ at the High Court.

The tribunal will have the most common mechanisms comparing to the regular courts to run any case. It will also be able to suggest the commission on any amendments to acts and laws related to the sector and any topics regarding licensing, tariff, regulation, policy of the companies related to this sector.
